Terms of Service

Welcome to Test Set Timer ("the App"), operated by Test Set Timer ("we", "us", or "our"). By accessing or using the App — whether on iOS, Android, or the web — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old to create an account. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App you represent that you meet these requirements.

2. Account Registration

To use certain features you must create an account with a valid email address and password, or sign in via a supported third-party provider (e.g., Google). You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

3. Subscriptions & Payments

• The App offers free and paid tiers. Paid subscriptions ("Pro" and "Pro Team") are billed through Apple App Store, Google Play, or another authorized payment processor.
• Prices are displayed in the App before purchase. We may change pricing at any time; changes will not affect an active billing period.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions through your device's app store settings.
• Refunds are handled by the applicable app store per their refund policies.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or disassemble any part of the App.
• Interfere with or disrupt the integrity or performance of the App or its servers.
• Upload or transmit harmful code, malware, or any content that infringes on the rights of others.
• Create accounts using automated means or impersonate another person.

5. Your Data

You retain ownership of the data you enter into the App (swimmer names, times, set configurations, etc.). We store your data on secure cloud infrastructure to provide the service. We will not sell your personal data to third parties.

You may delete your account and request deletion of your data by contacting us at the email below. Upon account deletion, your data will be permanently removed within 30 days.

6. Team Sharing & Collaboration

If you invite others to your team, you grant them access to view and edit shared team data (rosters, sets, and results). You are responsible for managing who has access. We are not responsible for actions taken by team members you have invited.

7. Intellectual Property

All content, design, code, and trademarks associated with Test Set Timer are owned by us or our licensors. You may not reproduce, distribute, or create derivative works from our materials without written permission.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that any defects will be corrected. Swim timing results are provided for informational purposes and should not be considered official results.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Test Set Timer and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will survive.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" above. Continued use of the App after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the state where we are headquartered.
